President Donald Trump has been hard at work trying to keep transgender troops out of the military. For now, though, it appears that that’s not going to happen.
The District of Columbia’s Federal District Court Judge Colleen Kollar-Kotelly was the one to make the decision about Trump’s policy earlier this week, on Monday, 12/18. She said that because the policy was a “disapproval of transgender people generally” that she would not approve it.
Had the ruling passed, it would have been active soon, this coming March. Kollar-Kotelly also called Trump’s proposal “unconstitutional,” so it seems unlikely that she will change her mind on her decision anytime soon.
Here’s what she had to say on the ruling:
“There is absolutely no support for the claim that the ongoing service of transgender people would have a negative effect on the military at all…In fact, there is considerable evidence that it is the discharge and banning of such individuals that would have such effects.”
Backing up her assertion that Trump’s ruling was unconstitutional, Judge Kollar-Kotelly added how “a number of factors — including the sheer breadth of the exclusion ordered by the directives, the unusual circumstances surrounding the President’s announcement of them, and the fact that the reasons given for them do not appear to be supported by any facts, and the recent rejection of those reasons by the military itself — strongly suggest the Plaintiff’s Fifth Amendment claim is meritorious.”
While transgender troops should certainly be celebrating this victory, they shouldn’t get too excited just yet. The Pentagon is now allowing for transgender troops into the military, but there are certain rules that must be met before doing so.
