Expanding the Supreme Court is a Terrible Idea

In recent weeks, prominent Democrats have proposed several “adjustments” to our system of government, including abolishing the electoral college and expanding the Supreme Court. In both cases, these proposals are designed only to give Democrats more power, and, in both cases, they are terrible ideas.

Regarding expanding the Supreme Court, nothing in the Constitution dictates that the Supreme Court must be composed of nine justices, meaning that Congress could theoretically expand the high court – otherwise known as “packing the court” – to 15, 30, or even 100 justices if they wanted. When Democrats propose expanding the Supreme Court, though, their only intention is to pack the court with liberal justices in order to eliminate the majority that conservatives have acquired.

However, even for those who don’t necessarily support a conservative majority Supreme Court, expanding the court any further is a terrible idea. The Supreme Court is supposed to be an unbiased, non-partisan entity, and expanding it for purely partisan and political purposes only serves to politicize the Supreme Court to a dangerous level. When you consider the fact that the next Republican Congress and President could always expand the court again to regain a majority, you end up with a very concerning cycle.
