Will Roe v. Wade Actually Be Overturned?

Following Justice Anthony Kennedy’s announcement that he was going to retire, conservatives across the country have been ecstatic about the possibility of having a reliable conservative majority in the Supreme Court for the first time in fifty years. There’s certainly a lot that can be accomplished with a conservative Supreme Court, from reaffirming religious liberties to fortifying Second Amendment rights. However, the case that has been on everyone’s mind since Kennedy announced his retirement is the controversial Roe v. Wade.

Roe v. Wade is the Supreme Court case that legalized abortion in the United States, and it’s a case that pro-life conservatives have been fighting to overturn ever since. For decades, overturning Roe v. Wade has been little more than a conservative fantasy. Now, though, with the balance of power in the Supreme Court shifting, it’s a real possibility.

Nevertheless, the chances of overturning Roe v. Wade outright still remain slim. The Chief Justice John Roberts – though a pro-life Catholic – does not believe that fundamental changes to existing laws should come about in the Court. A more likely scenario is that the issue of abortion will be left up to the states, with the Supreme Court affirming the states’ rights to make abortion illegal or legal as they see fit.
